Andrew J. McDonald, a justice on the Connecticut Supreme Court, joined in a 4-3 majority in 2015 to rule that the death penalty violates the state constitution's ban on cruel and unusual punishment.

It was a surprising ruling, because it went beyond what the defendant in the case (State v. Santiago) was seeking:  He wanted the court to declare that since the state legislature had abolished the death penalty in 2012 for cases after that date, then his own death penalty sentence should be vacated, as well, even though the murder he was convicted for took place in 2000 before the bill was passed.
