Arrests made at a border checkpoint in Woodstock, New Hampshire set up by Border and Customs Enforcement agents that local cops used to find small amounts of marijuana violated the New Hampshire Constitution and the federal constitution, a judge ruled.
The state judge found that New Hampshire case law prohibits using a dog to detect illegal items in a car without a reasonable basis for using a dog in the first place, and that federal case law prohibits using border checkpoints as a means of detecting crimes other than entering the country illegally, according to The Union Leader.
